The following General Terms & Conditions apply to all services rendered between us and a consumer in the form valid at the time the order is placed. A consumer means every natural person who enters into a legal transaction for purposes that predominantly are outside the consumer’s trade, business or profession (Sec. 13 German Civil Code (BGB)).

(1) The following regulations regarding conclusion of a contract apply to orders made via our online shop shop.klosterbraeu.com.

(2) In the event a contract is concluded, this is entered into with

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer on their part to conclude a purchase agreement.

(4) The following regulations apply upon receipt of an order in our online shop: The Consumer makes a binding contractual offer by successfully completing the designated order process in our online shop.

The order process involves the following steps:

1.    Selection of the desired goods

2.    Confirmation by clicking on the button marked “Order”

3.    Review of the details in the cart

4.    Clicking the button marked “Checkout”

5.    Possible login to the online shop following registration and entering the login details (e-mail address and password)

6.    Additional review and/or correction of the details entered

7.    Binding submission of the order by clicking on the button marked “Order and pay” or “Buy”

Prior to binding submission of the order, the Consumer may, after reviewing their details, click on the “back” button of the internet browser in use to return to the webpage on which the customer details are entered in order to correct any errors, or close the internet browser to terminate the order process. We will confirm entry of the order immediately by means of an automatically generated e-mail (“order confirmation”). This constitutes our acceptance of your offer.

(5) Retention of the contract text for orders made via our online shop: We save the contract text and send you the order details by e-mail. You can view the T&Cs at www.klosterbraeu.com/wellnesshotel-tirol/agb at any time. You can view your past orders in our customer area under My account/My orders.

(6) Only persons aged 18 and over may purchase items in our online shop.

(1) The essential characteristics of the products are contained in the respective product description.

(2) Products may deviate from the pictures. Errors in and changes to items are reserved.

(3) In the case of limited availability or unavailability of an item, we will make efforts to supply the item within 14 days.

(4) In the event that the purchased item is faulty, the statutory provisions apply. Excepted from this are items that have not been used in the intended manner, for new goods two years from the time of delivery to the customer.

(1) Vouchers may not be exchanged for cash. Should the redeemed amount be lower than the value of the voucher, we shall create another voucher.

(2) The voucher is deemed valid when the due amount has been paid in full.

(3) An invoice with tax statement can only be issued at the time the service is actually rendered, i.e. when the voucher is redeemed.

(4) We assume no liability for late postal delivery.

(5) Hotel Klosterbräu Seyrling GmbH shall offer no replacement in the event of loss, theft, or voiding of vouchers.

(1) The prices listed include the statutory sales tax and other price components. Any delivery costs are not included.

(2) The Consumer has the possibility to make payment by , advance payment by bank transfer, PayPal, credit card (Visa, Mastercard).

(3) If the Consumer chooses to make advance payment by bank transfer, they are obliged to pay the purchase price immediately after conclusion of the contract.

(1) Unless clearly stated otherwise in the product description, all items offered by us are available for immediate dispatch. In this case, delivery shall be made within 7 working days. The delivery period in the case of advance payment by bank transfer begins on the day after the payment order is submitted to the bank charged with the transfer; for all other payment methods, the delivery period begins on the day after conclusion of the contract. If the delivery deadline falls on a Saturday, Sunday, or public holiday in the delivery location, the period shall end on the next working day.

(2) Even when the purchase is to be shipped, the risk of accidental loss or deterioration of the purchased item passes to the purchaser at the time the goods are handed over to said purchaser.

(1) Please return products to us within 14 days of receipt. It is sufficient if the written statement of withdrawal or cancellation is sent within 14 days. However, the right of withdrawal does not exist if usage of the item begins within the withdrawal period. This right of return applies for consumers in accordance with the Consumer Protection Law.

(2) In order to exercise your right of withdrawal, you must inform us at

of your decision to withdraw from the contract by means of a clear statement (e.g. a letter sent by post, fax, or e-mail).

(3) If you withdraw from the contract, we must refund all payments which we have received from you without delay and at the latest within 14 days from the day on which we received notification of your withdrawal from this contract. For this refund, we will use the same payment method that you used for the original transaction, unless another agreement has been expressly made with you. We can refuse to make the refund until we have received the returned goods or until you provide us with proof that the goods have been returned, whichever occurs first.

(4) The costs for the return postage shall be assumed by the purchaser.

The item remains our property until full payment of the purchase price has been made.

The statutory warranty provisions apply.

The language of the contract is German.
